Terms and conditions

1. About these terms
BubblePOS is a product of BriteBridge Solutions Private Limited, a company incorporated in India, of Madhapur, Hyderabad, Telangana, India ("BriteBridge", "we", "us"). These terms apply when you visit bubblepos.com, use BubblePOS at a restaurant's own address or in our Android, iOS, Windows or Mac apps or the store hub, order from a restaurant's online ordering page, or use our partner panel.
These terms are an electronic record under the Information Technology Act, 2000 and the rules made under it, and need no physical or digital signature. You accept them when you sign an order or agreement with us that refers to them, or when you use BubblePOS. If you accept them for a business, you confirm that you are authorised to bind that business. Section 10 says what applies to guests who order from a restaurant. Our privacy policy explains how we handle personal data and forms part of these terms.
If you have a signed order form or written agreement with us that says something different, that agreement wins for your account.
2. Words we use
- Customer: the restaurant or business that subscribes to BubblePOS. In the sections written for Customers, "you" means the Customer.
- Users: the owners, managers and staff a Customer lets use BubblePOS.
- Guests: people who order from, visit or deal with a Customer.
- Customer Data: the information a Customer and its Users put into BubblePOS, such as menus, orders, bills, guests, staff and stock.
- Plan: the BubblePOS plan, price, billing cycle and limits agreed for a Customer.
3. Who can use BubblePOS
If you use BubblePOS for a business, you must be 18 or older and able to enter into a contract under the Indian Contract Act, 1872. BubblePOS is for running a business, not for personal use. Give us accurate, complete details and keep them up to date.
4. Accounts and users
- The Customer's owner decides who can use BubblePOS and what each User can see and do, through the roles BubblePOS provides.
- Keep passwords private. The Customer is responsible for what its Users do in BubblePOS, and must tell us at once at grievance@bubblepos.com if it suspects an account has been misused.
- Our support team may open a Customer's account to help it or to fix a problem. Each such session is time-limited and logged.
5. Plans, fees and payment
- Your Plan, its price and its billing cycle (monthly, quarterly or yearly) are as agreed with you when your account is set up, or as changed later in writing.
- Fees are paid in advance for each billing cycle and are due on the date shown on the invoice. Fees do not include GST or other taxes, which are added at the rates in force.
- If you deduct tax at source (TDS) from our fees, send us the TDS certificate within the time the law allows.
- Your Plan continues into the next billing cycle unless you tell us before the renewal date that you want to stop. We send an invoice for each cycle and remind you before the renewal date.
- If a payment is overdue, we will remind you. If it is still unpaid 15 days after the reminder, we may suspend the account until it is paid. Suspension does not delete your data.
- We may change our prices with at least 30 days' notice. A new price applies from your next renewal.
- If we offer you a trial, it costs nothing for the period we agree with you and may have limits. When it ends you can choose a Plan; if you do not, we may close the trial account, and its data is then handled as section 13 says.
6. Cancellation and refunds
- You can cancel at any time by telling us. Cancelling stops the next renewal; you keep using BubblePOS until the end of the billing cycle you have paid for.
- Fees are not refunded once a billing cycle has started, including for a part of a cycle or for features you did not use.
- This does not apply where the law requires a refund, where we charged you by mistake (we refund the excess), where we end BubblePOS for you without any fault of yours (we refund the fees paid for the unused part of the cycle), or where section 21 says so.
7. Setting up
We set up your account from what you give us, such as your menu, tables, tax details and staff. Check what we set up before you rely on it. You are responsible for the accuracy of your prices, taxes, and the details printed on your bills.
8. Your responsibilities
- Use BubblePOS only for lawful purposes and in line with these terms.
- Follow the laws that apply to your business, including those on GST, food safety (FSSAI), legal metrology, consumer protection, labour and wages, and data protection.
- For your staff's and guests' personal data you are the Data Fiduciary under the Digital Personal Data Protection Act, 2023: give them the notices the law requires, get consent where it is needed, and answer their requests. We process that data on your behalf and on your instructions, as your Data Processor.
- Have the rights to the photos, logos and other content you upload.
- Pay the fees for your Plan on time.
9. Tax, payroll and compliance tools
BubblePOS works out GST, payroll deductions (such as PF, ESIC, professional tax and TDS) and other figures from the settings and rates you choose. It is a tool, not tax, legal or accounting advice. Check its figures with your chartered accountant: you remain responsible for your returns, payments, registrations and records. Unless we agree otherwise in writing, BubblePOS does not file returns for you or connect to government portals, such as the GST e-invoice portal.
10. Online ordering pages and guests
For Customers who use the online store, the table QR code or the feedback link:
- You are the seller. You are responsible for your menu, prices, taxes and charges, the food, its preparation and delivery, and for cancellations, refunds and complaints.
- Show guests the details the law requires of you, such as your legal name, address and contact details, your FSSAI licence number, prices with all taxes and charges, and your cancellation and refund policy, and follow the Consumer Protection (E-Commerce) Rules, 2020 where they apply to you.
- Online payments go to your own payment account with the payment company you connect (such as Razorpay, PhonePe or Paytm), under that company's terms. BriteBridge does not collect, hold or settle money for you. Refunds to guests are made by you, through the same payment company.
For guests who order from a restaurant's ordering page or a table's QR code:
- Your order is a contract between you and the restaurant. The restaurant is responsible for the food, its price and taxes, delivery, cancellations and refunds. BriteBridge provides the technology only and is not a party to your order.
- For a problem with an order, contact the restaurant first. For a problem with the page itself, contact our Grievance Officer (section 22).
- Nothing in these terms limits your rights as a consumer under the Consumer Protection Act, 2019.
11. Messages to guests and staff
BubblePOS sends SMS or WhatsApp messages only through an account the Customer connects with its own provider (such as MSG91, Twilio or Meta's WhatsApp Business Platform), and the Customer pays that provider. Send messages only where you have the recipient's consent or another lawful basis, and follow the Telecom Regulatory Authority of India's rules on commercial communications and your provider's policies. BubblePOS keeps an opt-out list and does not message a number on it.
12. Things you must not do
- Upload, show or share anything that belongs to someone else without the right to, or that is unlawful, obscene, pornographic, invasive of someone's privacy (including bodily privacy), defamatory, insulting or harassing on the basis of gender, race, caste or religion, harmful to children, knowingly false or misleading, infringing someone else's rights, impersonating someone, connected with money laundering or gambling, promoting enmity between groups, threatening the unity, integrity, defence, security or sovereignty of India, friendly relations with other countries or public order, or that contains viruses or other harmful code.
- Try to get into accounts, data or systems that are not yours, test or break BubblePOS's security, or overload it.
- Copy, modify, reverse engineer, resell or rent BubblePOS, or use it to build a competing product, except as the law expressly allows.
- Collect other people's data from BubblePOS by automated means.
We may remove content that breaks these rules, and suspend or end the account involved. We act on complaints and on lawful orders of courts and government agencies within the time the law sets, and may report unlawful activity to the authorities.
13. Your data
- The Customer owns its Customer Data. It lets us host, copy, process and show that data only to provide and support BubblePOS, including on its own ordering page.
- As your Data Processor under the Digital Personal Data Protection Act, 2023, we process the personal data in Customer Data only to provide BubblePOS and on your instructions; keep it secure; use only service providers who are bound to protect it (today Vercel and Neon, which host BubblePOS and its database); tell you without delay of a personal data breach that affects it; and help you answer your staff's and guests' requests.
- You can ask us for a copy of your Customer Data while your account is open and for 30 days after it ends. At the end of those 30 days we delete it, apart from records the law requires us to keep.
- We may use data that cannot identify any person, restaurant or guest to understand and improve BubblePOS.
14. Our software and brand
BubblePOS, its software, design and brand belong to BriteBridge or its licensors. While your Plan is active, we give you a limited, non-exclusive, non-transferable right to use BubblePOS for your business. If you send us feedback or ideas, we may use them without owing you anything.
15. Other companies' products
BubblePOS works with products and services from other companies, such as payment companies, SMS and WhatsApp providers, printers, cash drawers, app stores and internet connections. Their own terms apply to them, we are not responsible for them, and a change on their side may change what BubblePOS can do with them. We do not supply or guarantee hardware unless we agree to in writing.
16. Availability and support
We work to keep BubblePOS available, secure and backed up, but we do not promise that it will always be uninterrupted or free of errors. BubblePOS needs the internet, apart from what the optional store hub keeps doing offline. We may pause it for maintenance, at quiet hours where we can. Support is available by phone, by email and through Help & support in BubblePOS, during our working hours in India.
17. Confidentiality
Each of us will keep the other's non-public business information confidential and use it only for these terms, except information that is already public, that the other already knew, or that the law requires to be disclosed.
18. Warranties and liability
- Apart from what these terms promise, BubblePOS is provided "as is", and we give no other warranty, as far as the law allows.
- Neither of us is liable for indirect or consequential losses, such as lost profits, revenue, business or goodwill.
- Our total liability to a Customer for all claims in connection with BubblePOS is limited to the fees that Customer paid us in the 12 months before the event that gave rise to the claim.
- Nothing in these terms limits fees you owe us, the Customer's obligations under section 19, liability for fraud, or any liability that cannot be limited under Indian law.
19. Indemnity
The Customer will compensate BriteBridge for losses, claims and reasonable costs that arise from its breach of these terms, its content, its dealings with its guests and staff, the messages it sends, or its failure to follow the laws that apply to its business.
20. Suspension and ending
- We may suspend or end an account if the Customer seriously breaks these terms and does not put it right within 15 days of our notice, if fees stay unpaid (section 5), if the law or a lawful order requires it, or straight away to stop serious harm or a security threat.
- If we stop offering BubblePOS, we will give at least 30 days' notice and refund the fees paid for the time after the end.
- When an account ends, access to it ends. Sections on fees owed, your data, confidentiality, liability, indemnity and disputes keep applying.
21. Changes to these terms
We may update these terms. We will post the new version here with a new date and tell Customers about important changes by email or in BubblePOS at least 15 days before they take effect, unless a change is needed sooner for legal or security reasons. If you do not accept a change, you may stop using BubblePOS before it takes effect; if the change significantly reduces what your Plan gives you, we then refund the fees paid for the unused part of your billing cycle.
22. Grievance Officer
For complaints about BubblePOS, about content on a BubblePOS page, or about how we handle personal data, contact our Grievance Officer, BriteBridge Solutions Private Limited, Madhapur, Hyderabad, Telangana, India: grievance@bubblepos.com or +91 99631 30526. We acknowledge a complaint within 24 hours and resolve it within 15 days. A complaint asking us to remove unlawful content is acted on within 72 hours, and within 24 hours for content that shows someone's private area or intimate act, or impersonates them, as the law requires.
23. Disputes and governing law
- These terms are governed by the laws of India.
- If a dispute arises, we will first try to settle it by talking, starting with the Grievance Officer, for 30 days.
- If it is not settled, it will be decided by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by agreement of both sides or, failing that, as the Act provides. The seat and venue of the arbitration will be Hyderabad, and it will be conducted in English.
- Subject to arbitration, the courts at Hyderabad, Telangana have exclusive jurisdiction, including for urgent interim relief.
- A guest's rights under the Consumer Protection Act, 2019, including the right to approach a consumer commission, are not affected.
24. Events outside our control
Neither of us is liable for a delay or failure caused by events beyond reasonable control, such as natural disasters, epidemics, war, government action, strikes, or failures of the internet, power or a provider's systems. This does not excuse paying fees that are already due.
25. General
- These terms, the privacy policy and any order form or written agreement with you are the whole agreement between us about BubblePOS.
- You may not transfer your account or these terms without our written consent. We may transfer them to a company that takes over BubblePOS, and will tell you.
- If a court finds part of these terms unenforceable, the rest still applies.
- If we do not enforce a right straight away, we have not given it up.
- We are independent of each other: nothing here makes us partners, agents or employer and employee.
- We send notices to the email address of the account's owner. Send notices to us at grievance@bubblepos.com or to our office in Hyderabad.
- If you are one of our partners, the partner terms we agree with you apply in addition to these terms.
